Quebec has followed suit with Act 25 modernizing privacy legislation in force since September 22, 2022. It covers various aspects such as your organization’s roles and responsibilities with respect to personal information, managing consent, disclosure and incident management, managing access to personal information, the right to be forgotten, etc.

The adoption of Act 25 allows individuals to benefit in particular from:

The improvement of the information received during the collection of personal information and an automated decision;
Information concerning the use of their personal information to make a decision based exclusively on automated processing and a right to present their observations to a member of staff able to review the decision;
Being notified of a confidentiality incident concerning their personal information when this incident presents a risk that serious harm will be caused;
A right to erasure and delisting;
Consents requested in simple and clear terms.

The law is the law! In addition to a negative reputation, a breach of your privacy obligations would expose your organization to significant penalties, up to $25 million or 4% of your global sales.

Establish a culture of protection of personal information

In order to establish a new culture of protection of personal information, public bodies, businesses and provincial political parties will have to resort to measures that mitigate the risks of infringement of the right to privacy of citizens. The responsibilities arising from these measures are intended to increase public confidence in the protection of their personal information.
