In force since September 2022, Act 25 on the protection of personal information aims to provide a framework for the protection of personal information held by businesses.

But the protection of personal information is more than just compliance with the law. There are several benefits to implementing a culture of protection of personal information, such as:

  1. Improve public confidence in your business, its image and reputation;
  2. Meet your customers’ expectations and develop a competitive advantage;
  3. Be attentive to your employees’ concerns about their information;
  4. Reduce the risk of a privacy incident, its consequences for people and its impact on your business;
  5. Meet your legal obligations and limit the risk of non-compliance (administrative monetary penalties and criminal offences);

What is personal information?

  • Personal information is information that relates to a natural person and allows that person to be identifiable. It is confidential.
  • Except in exceptional cases, they may not be disclosed without the consent of the person concerned.

In order to establish a new culture of protection of personal information, public bodies, businesses and provincial political parties will have to resort to measures that mitigate the risks of infringement of the right to privacy of citizens. The responsibilities arising from these measures are intended to increase public confidence in the protection of their personal information.
